Injured While Working as a Volunteer
If you have been injured while working as a volunteer in California, you may be wondering if you are eligible to receive workers’ compensation.Question:
Can I qualify for workers’ compensation if I am injured while working as a volunteer?
Answer:
I recently received a phone call from a volunteer at an organization. The volunteer had gotten injured at the organization and was asking me whether or not their injury was covered under Workers’ Comp. I would say the general rule is that, as a volunteer, you’re not an employee, and therefore your claim wouldn’t be covered under Workers’ Comp. That being said, it was important for that volunteer to reach out to an attorney because their claims very well still may be covered under California’s other statutory frameworks. It’s important that, if you’re a volunteer and get injured while working for that organization, that you find an attorney to figure out whether or not those claims are either covered under California Workers’ Compensation or another California statute. If you have questions because you got injured while volunteering for an organization, feel free to give me a call. I’m always happy to help answer your questions.
